Improving Lead Flow by 25%-200% Money Back Guarantee Offer Details and Terms and Conditions:
  1. The Captivate increase in lead flow Money Back Guarantee applies to new Captivate Agreements executed between August 1, 2010 and September 30, 2010.

  2. The improvement in lead flow is for leads generated through the Franchisor’s (Your) franchise development website. E.g. If you currently get 50 leads/ month from your franchise development website, the Captivate guarantee would improve the leads to a minimum of 63 leads/ month. A minimum of 25% increase.

  3. To calculate the Base Level (“Base Level”) over which Captivate will increase the lead flow, we (Captivate) shall look at the number of unique visitors to your franchise development website and the number of leads/ month generated from your franchise development website over the last 4 months prior to implementing Captivate solution. Measuring this data typically requires the implementation of Google Analytics or equivalent package on your franchise development website.

  4. Since Captivate has no control over your marketing activities and your SEO strategy that drives visitors to your website, in order to avail of the money back guarantee, we require that the number of unique visitors to your franchise development website do not decrease below the base Base Level described in section 2.

  5. The improvement in lead flow by using Captivate are likely to take One (1) to Four (4) months from the date Captivate is implemented. If You do not see any improvement in Lead flow even after four months from the date Captivate is implemented and there is no decrease in the number of unique visitors to your website from the Base Level, you shall be then eligible to avail the Money Back Guarantee offer.

  6. The Money Back guarantee is only available on the Setup Fee you paid for implementing the Captivate Service. This guarantee does not cover the monthly fee you pay for use of the Captivate Service or costs of any customizations specific to the Customer. E.g. If you paid $15000 as Setup fee for Captivate and are spending $500/ month as Service fees, the Money Back Guarantee only covers the refund of $15,000 you paid in Setup fee. Once the refund of Setup fee is provided, your commitment to use the Captivate Service and our Commitment to provide the Service shall end and either party may terminate the Service Agreement without incurring any additional costs or penalties.

  7. Any customer who has breached or whose account has been suspended or terminated due to the breach of any part of the FranConnect Service Agreement including but not limited to the Section involving Payment of Fees has automatically forfeited the right to use the Captivate Money Back Guarantee.

  8. FranConnect shall, in its sole discretion, determine whether all requirements for the Guarantee have been satisfied and may terminate or modify the Guarantee program on a prospective basis at any time. We reserve the right at any time to amend, modify the content of the terms without prior notification.

  9. Any relevant terms and conditions, policies and notices shall be governed by and construed in accordance with the laws of Commonwealth of Virginia without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of the laws of Commonwealth of Virginia in respect of any disputes arising in connection with the Money Back Guarantee, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith.
